Court rules against Westpoint investors 10 July 2008
Westpoint investors cannot claim their losses on their financial planner's insurance. The NSW Supreme Court ruled yesterday that because the Westpoint products were not included on the planners list of approved investment products, they were not covered by insurance. Lawyers acting for the investors in the case said the ruling was a major setback for all investors because there was no requirement for planners to disclose their list of approved products that are covered by professional indemnity insurance. Recent reforms requiring insurance by planners would not cover this issue they said.
