Lenders can not try to recoup loans that were fraudulently arranged by external brokers says the corporate watchdog ASIC. Lender FirstMac is in court attempting to recover $1.95 million in loans to three couples who invested in failed property group Streetwise. The couples allege that Streetwise held itself out as the lender and FirstMac allowed the investment group to control the application process, thereby setting up an 'agency' relationship. The lawyers for the lender allege that the borrowers were careless in allowing the broker to fill in inaccurate income and financial details on their loan application forms.
